Please read these Terms and Conditions (“Terms”) carefully before using the Flow Music Application (“Flow”). These Terms govern your access to and use of the services provided by Flow Music Application, including the discovery and streaming of music tracks, curated music videos, MTVs, audio/podcasts, selected movies, audiobooks, educational materials, and any other content offered through the application. By accessing or using Flow, you signify your agreement to these Terms.

1. INTRODUCTION
1.1 Flow Music Application is a platform designed to provide users in Myanmar, including Myanmar nationals and individuals residing in Myanmar, with a comprehensive music streaming and content discovery experience. Through an algorithm-based recommendation system, Flow offers personalized music tracks and videos based on user preferences and listening habits.
1.2 By accessing or using Flow, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from using Flow.

2. USER ELIGIBILITY
2.1 Flow Music Application is available only to individuals who are 13+ to access and use the application in Myanmar in accordance with the Children's Online Privacy Protection Act (COPPA). By accessing and using Flow, you confirm that you meet the eligibility criteria and agree to comply with these Terms.

3. SERVICES PROVIDED
3.1 Flow Music Application offers a diverse range of content, including music tracks, music videos, MTVs, audio/podcasts, selected movies, audiobooks, educational materials, and more. These services are provided under the conditions outlined in these Terms. By subscribing to and using Flow, users acknowledge that they may have access to various types of content and are solely responsible for their usage.
3.2 Flow reserves the right to modify, suspend, or discontinue any part of the services or features provided through Flow Music Application at any time without prior notice or liability.

4. USER RESPONSIBILITIES
4.1 Compliance with Laws and Regulations: Users of Flow Music Application must comply with all applicable laws and regulations while using the platform. It is strictly prohibited to engage in any illegal activities, infringe upon copyrights, or violate the rights of others.
4.2 Account Creation: To access and use Flow Music Application, users must create an account and provide accurate personal information, including a valid phone number. Users are responsible for maintaining the confidentiality of their account credentials and agree to promptly update any changes to their personal information.
4.3 Users are solely responsible for any activities that occur under their account. Flow shall not be liable for any unauthorized access to or use of user accounts.
4.4 Users are strictly prohibited from sharing their account credentials with others or allowing others to access their account. Users are responsible for all actions and content uploaded or submitted through their account.
4.5 Users agree not to use or access Flow Music Application for any fraudulent, unlawful, or unauthorized purposes.
4.6 Users agree not to use Flow Music Application in any manner that could disable, damage, or impair the application or interfere with any other party’s use of the application.

5. USER CONDUCT
5.1 Respectful Behavior: Users of the Flow Music Application must conduct themselves in a respectful manner towards other users and the community. Harassment, hate speech, spamming, or any form of abusive behavior will not be tolerated.
5.2 User-Generated Content: Users are responsible for any content they upload or submit through Flow Music Application. Content that is infringing, illegal, or violates the rights of others is strictly prohibited.
5.3 Users acknowledge that any content uploaded or submitted through Flow Music Application may be reviewed, monitored, or removed by Flow if it violates these Terms or any applicable laws or regulations.
5.4 Users grant Flow Music Application a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the user-generated content in connection with the provision of the services offered by Flow.

6. FRAUDULENT AND SUSPICIOUS BEHAVIOR
Flow reserves the right, in its sole discretion, to determine whether a user is engaged in fraudulent or suspicious behavior while using the platform. This includes activities that may artificially inflate stream counts, manipulate engagement metrics, or violate our usage policies. If Flow reasonably suspects that a user is involved in such behavior, Flow reserves the right to take appropriate actions, including, but not limited to:
6.1 Stream Count Evaluation: Flow may assess streams that are suspected to be a result of fraudulent or suspicious activities. Streams identified as such may be excluded from the user’s total stream count and relevant metrics.
6.2 Account Sanctions: Flow may impose sanctions on accounts found to be engaging in fraudulent or suspicious behavior, which could entail temporary suspension or permanent termination of access to the platform.
6.3 Investigation: Flow may initiate investigations into accounts or actions suspected of fraudulent or suspicious behavior. This may involve analyzing usage patterns, engagement metrics, and other relevant data.
By using the Flow platform, you acknowledge and agree to abide by all usage guidelines, terms, and conditions established by Flow. You understand that Flow’s judgment on fraudulent or suspicious behavior is final and binding.

7. USER FEEDBACK AND SUGGESTIONS
7.1 Flow Music Application welcomes user feedback, suggestions, and ideas for improving its features and services. By submitting such feedback, users acknowledge that Flow Music Application may use these suggestions without obligation or compensation.
7.2 Flow Music Application shall have no obligation to consider, acknowledge, or implement any feedback or suggestions provided by users.

8. ACCOUNT SECURITY
8.1 Users are responsible for maintaining the security of their accounts. This includes using strong passwords, regularly updating passwords, and refraining from sharing account credentials with others.
8.2 Users agree to notify Flow immediately of any unauthorized access to or use of their account or any other security breach.
8.3 Flow Music Application shall not be liable for any loss or damage arising from a user’s failure to comply with these security obligations.

9. THIRD-PARTY SERVICES AND LINKS
9.1 Flow Music Application may include links or integration with third-party services or websites. Users acknowledge that these third-party services are subject to their own terms and conditions, and they should review them separately.
9.2 Flow Music Application does not endorse, control, or assume any responsibility for the content, privacy policies, or practices of any third-party services or websites.
9.3 Users acknowledge and agree that Flow Music Application shall not be liable for any loss or damage caused or alleged to be caused by or in connection with the use of any third-party services or websites.

10. LIMITATION OF LIABILITY
10.1 Disclaimer of Warranty: Flow Music Application is provided on an “as is” basis. Flow does not warrant the accuracy, completeness, or availability of the content and services provided. Users acknowledge that the use of Flow Music Application is at their own risk.
10.2 Limitation of Liability: Flow Music Application, its affiliates, and employees shall not be liable for any damages, losses, or injuries arising from the use of the application. This includes, but is not limited to, direct or indirect damages, incidental damages, or consequential damages.

11. INDEMNIFICATION
11.1 Users agree to indemnify and hold Flow Music Application, its affiliates, and employees harmless from any claims, damages, or losses arising from their use of the application or violation of these Terms.

12. SEVERABILITY
12.1 If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid and enforceable. The remainder of the Terms will continue in full force and effect.

14. SUBSCRIPTION PLANS AND SERVICES
14.1 Flow Music Application provides various subscription plans and services that may be subject to fees and additional terms. By subscribing to these plans or using the associated services, users agree to the specific terms and conditions applicable to each plan or service.
14.2 Users acknowledge that certain subscription plans may automatically renew and that they are responsible for canceling their subscription before the renewal date to avoid additional charges.

15. CHANGES TO TERMS
15.1 Flow Music Application may introduce new features, updates, or changes to its services, which may require user consent or acceptance of revised terms. Flow will notify users of any significant changes to these Terms. Continued use of Flow after such notifications will constitute acceptance of the modified Terms.

16. GENERAL PROVISIONS
16.1 These Terms constitute the entire agreement between you and Flow Music Application and supersede any prior agreements or understandings. These Terms shall be governed by and construed in accordance with the laws of Myanmar. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Myanmar. By using the Flow Music Application, you agree to abide by these Terms and Conditions. If you do not agree to these Terms, you must refrain from using Flow.

17. REFUND ELIGIBILITY
17.1 Flow Music Application offers a subscription-based service that grants users access to premium features. If you have purchased a subscription plan, you may be eligible for a refund within the first few days of your initial subscription purchase.
17.2 To request a refund, users must submit their refund request through the application’s customer support at support@flow.com.mm The refund request must include the user’s account information and a reason for the refund.
17.3 Flow Music Application reserves the right to review refund requests on a case-by-case basis. Refunds will be processed according to the original payment method used for the subscription purchase.
17.4 Users who have violated these Terms and Conditions or engaged in fraudulent activities are not eligible for a refund.

18. CANCELLATION OF SUBSCRIPTION
18.1 Users may cancel their subscription at any time by accessing their account settings within the application. Upon cancellation, the premium features will remain accessible until the end of the current billing period.
18.2 Refunds for cancellations will not be provided for partial subscription periods, and users will continue to have access to the premium features until the end of their current billing cycle.

19. MODIFICATIONS TO THE REFUND POLICY
19.1 Flow Music Application reserves the right to modify or update the refund policy at its discretion. Users will be informed of any changes to the refund policy through the application’s website or by direct notification within the application.
19.2 Continued use of Flow Music Application after any modifications to the refund policy will indicate your acceptance of the revised refund terms.

By using the Flow Music Application, you acknowledge that you have read and agreed to the Refund Policy outlined above, in addition to the rest of the Terms and Conditions. If you do not agree to the Refund Policy or any other part of these Terms, you must refrain from using Flow.
